Niche York Design is the primary host for myniche.nl. These are the terms and conditions for the use of our website myniche.nl and the purchase of products and services through the website. We may change these terms at any time. The latest version will always be on this website. By continuing to use the site or placing an order, you agree to the updated terms. These terms, along with any notices on this website, explain how you may use the site and how purchases are handled. We may update them at any time without prior notice. By using the site or placing an order, you accept any updated terms.
A contract is formed once your order has been processed and confirmed. This simply means we’ve officially agreed to provide the product or service you purchased.
By placing an order, you confirm that:
– You are legally able to enter into an agreement.
– The information you provide is accurate and complete.
– You are not using false or unauthorised details.
Digital Services (e.g., MyNiche webpages, custom designs): Work begins once your order is accepted. You will not have access until setup and design are completed. Specific revisions are included unless otherwise stated; additional revisions may incur a fee.
Digital Products (workshops, templates, guides): Delivered electronically upon purchase. Refunds or cancellations are not possible once the file is accessed.
Physical Products: May be returned or cancelled according to our Delivery & Returns Policies.
All products and services are provided “as is”, without guarantees beyond what is described. We cannot guarantee they will work on every device or situation.
Customers are responsible for protecting their own devices and data.
To the fullest extent permitted by law, Niche York Designs is not liable for indirect, incidental, or consequential loss, including loss of income, data, or goodwill.
Nothing in these terms limits your statutory rights under Dutch or EU law.
All digital and physical products remain the property of Niche York Designs unless otherwise specified. Customers may not copy, redistribute, or claim ownership of our materials.
Customers are responsible for applicable taxes in their country. Niche York Designs complies with Dutch and EU VAT laws for digital services and products.
If payment is not received by the due date, Niche York Designs reserves the right to use a professional debt collection agency, such as Nova Incasso to recover the outstanding amount. Any costs associated with collection may be added to the amount owed by the customer, in accordance with Dutch law.
These terms and conditions are governed by the laws of the Netherlands. Any disputes arising from your use of this website, or from the purchase of products or services, will be resolved in the courts of the Netherlands.
This means that Dutch law applies to your order and any legal matters, and any legal action must be brought in a Dutch court. This ensures clarity and consistency for both customers and our business.

Digital Services (Custom service)
Custom digital services usually take up to 2 weeks to begin, depending on the current waiting list. Delivery is considered complete once access is granted. Previews or updates may be provided during production.
Digital Products - Downloads and Access (Workshops, Templates, Guides)
Delivered instantly upon purchase. Customers are responsible for downloading and backing up necessary files.
Physical Products
Only available for delivery within the Netherlands.
Orders are usually dispatched within 3–5 business days after payment.
Once handed to the courier, responsibility for transit delays or damages passes to the delivery service.
If an item arrives damaged, report it within 48 hours; we will assist in filing a claim or arranging a replacement.
Digital Services
If you cancel before any work has started or fail to provide the required information (for example, for MyNiche webpages or add-ons), you will receive a refund minus a 25% administration and processing fee
If you cancel after production has started, you will receive a refund minus 50% for admin and processing fees, regardless of how far the process has progressed .
If you cancel after the project is completed, you will receive a refund minus 75% for admin and processing fees.
These percentages serve as our standard policy; however, any refund offered will ultimately be issued at our discretion.
Digital Products - Downloads or Access
Once delivered, instant digital products (such as templates, workshops or Guides) cannot be refunded unless:
The file is corrupted or won’t open
The file delivered did not match the item description
The file is missing elements that were advertised
There are major design errors or technical faults
The file format isn’t what was described (e.g., PDF instead of PNG)
Download link didn’t work
The file quality is too low (e.g., blurry graphics)
Physical Products
Orders can be cancelled before dispatch. See Delivery and Shipping policy for dispatch times.
Returns accepted within 14 days of delivery if items are unused, unwashed, and in original packaging.
If a return is due to a faulty or incorrect product, we cover return shipping. If a return is due to customer change of mind, the customer pays for return shipping.
All returns must be requested through the return page. Once approved, a return label can be provided. If the refund amount does not cover the shipping costs, you will be responsible for returning the item.
Refunds are issued once the returned item is received and inspected.
Report damaged items within 48 hours. We will assist with courier claims or provide replacements where possible.
